I worked 13 hours in one day but only 30 hours that week. Do I get overtime?

Yes. California counts overtime by the day as well as by the week. On a 13-hour day you earn 8 hours at your normal rate, 4 hours at 1.5×, and 1 hour at 2× — even though the week never reached 40 hours. The weekly total does not cancel the daily rule.

I use my own phone for the work group chat. Should my employer pay for that?

Yes, a reasonable percentage of your bill. California requires employers to reimburse necessary business expenses, and courts have held that applies to work use of a personal phone even when you are on an unlimited plan and paid nothing extra. The employer cannot benefit from a cost you carry.

My assistant manager is on salary and works about 55 hours a week. Do I owe overtime?

Probably yes. A salary alone does not make someone exempt in California. The role must also pass a duties test and the salary must be at least twice the state minimum wage for full-time work — $70,304 a year in 2026. Miss either one and every hour past 8 in a day or 40 in a week is owed.

We got slammed and I ate at the counter in about 15 minutes. Is that a problem?

Yes, and it costs one extra hour of pay for that day. A California meal period must be at least 30 uninterrupted minutes, free of all duty, and must start before the end of the fifth hour. A 15-minute break at the counter meets none of those, so a premium is owed.

My boss says I can take my 10-minute break but has to keep my phone on. Is that allowed?

No. A California rest period has to be free of duty and free of employer control, which means off-call as well as off-task. Being required to stay reachable and interrupt the break on demand defeats it, and your employer owes one hour of premium pay for that workday.

I clock out and then lock up and set the alarm. It is maybe 8 minutes. Does that count?

Yes, it counts and it must be paid. California does not apply the federal rule that lets employers ignore small amounts of time. Eight minutes of closing work after clocking out, happening every shift, is compensable — and the fact that it is easy to record now is part of why.

We check bags on the way out but staff clock out first. Is that OK?

No. Time spent waiting for and undergoing an employer-required bag or device check is hours worked in California, because the employee remains under your control the whole time. Running the check after the punch converts it into unpaid time — the fix is to run it before.

My employee has sick hours left in December. Do they disappear on January 1?

No. Accrued California paid sick leave carries over to the next year. You may cap accrual and cap annual use, but you cannot zero out an unused balance. The statewide floor since 2024 is 40 hours or 5 days available per year, and some cities require more.

Our handbook says unused vacation is forfeited at year end. Is that enforceable in California?

No. Earned vacation is a form of wages in California, it vests as you work, and it cannot be forfeited. A "use it or lose it" clause is unenforceable no matter what the handbook says, and the balance must be paid out at the employee's final rate when they leave.

I quit today with no notice. When does my employer have to pay me?

Within 72 hours. If you quit without notice your final pay is due within 72 hours; if you gave at least 72 hours' notice, it is due on your last day. If you were fired or laid off, it is due immediately. Late final pay can trigger waiting-time penalties of up to 30 days' wages.

Yes. Reporting time pay applies when an employee shows up for a scheduled shift and is given less than half of it. You owe half the scheduled shift, with a minimum of two hours and a maximum of four — so for a typical shift cut after one hour, that is usually two to four hours of pay.

The higher one. California's state minimum is $16.90 an hour in 2026, and dozens of cities and counties set local minimums above it. Where an employee performs work, the most generous applicable rate governs — state, local, and any industry-specific rate all stack that way.

Yes. On the seventh consecutive day of a single workweek, the first 8 hours are paid at 1.5× and everything beyond 8 at 2×. This applies to the seventh day itself regardless of how many hours the week totalled — it is a separate rule from the daily and weekly overtime tests.
